Canadian Limpet Application

Limpet was applied in Canada from about 1934 to about 1974. As a general matter, the distribution system worked as follows. From 1934 to on or about April 21, 1964, Limpet was manufactured in England by J.W. Roberts Limited (“Roberts”), which sold and shipped it to a head licensee in Canada; after that date, the head licensee manufactured Limpet in Canada. The head licensee leased from Roberts the machines used to spray the material and the head licensee had the right to sub-license the product and sub-lease the machines to experienced insulation applicators around Canada

The head licensee for Limpet in Canada was:

Atlas Asbestos Corp. of Montreal, Canada (“Atlas”). Atlas was the head licensee for Canada from about 1934 to 1974 (it was also the head licensee for the U.S. from March 1, 1967 to March 1973). Atlas was a Limpet applicator as well as the head licensee of the product. Beginning on or about April 21, 1964, Atlas, not Roberts, manufactured Limpet for sale in Canada.¹

¹ By including this information about Atlas, the Debtors are not assuming in any way responsibility or liability for Limpet manufactured by Atlas for sale in Canada after April 21, 1964, and the Debtors do not waive and expressly reserve any and all rights with respect to claims that they are responsible for such Limpet.
