U.S. Limpet Application

Limpet was applied in the U.S. from 1934 to 1973. As a general matter, the distribution system worked as follows. J.W. Roberts Limited (“Roberts”) manufactured the dry Limpet formula in England and sold and shipped it to a head licensee in the U.S. The head licensee leased from Roberts the machines used to spray the material and the head licensee had the right to sub-license the product and sub- lease the machines to experienced insulation applicators around the U.S.

The head licensees for Limpet in the U.S. were:

     Keasbey & Mattison Company of Ambler, Pennsylvania (“Keasbey”). Keasbey was the head licensee for the U.S. from 1934 to August 1962. Keasbey went out of business in 1962. Keasbey served as head licensee only; it was not itself an applicator of Limpet.

     ACandS Inc., formerly known as Armstrong Contracting & Supply Corp., of Lancaster, Pennsylvania (“ACandS”). ACandS was the head licensee for the U.S. from August 1962 to February 28, 1967. ACandS was a Limpet applicator as well as the head licensee of the product.

     Atlas Asbestos Corp. of Montreal, Canada (“Atlas”). Atlas was the head licensee for the U.S. from March 1, 1967 to March 1973, when sales of Limpet in the U.S. were discontinued (it was also head licensee for Canada from about 1934 to 1974). Beginning with the March 1, 1967 appointment of Atlas as head licensee for the U.S., Atlas, not Roberts, manufactured Limpet for sale in the U.S.¹
